Trump Has Lost Congress. Bitcoin Is Rising Anyway. What Awaits Investors Now?

The US elections brought a fundamental political shift that could change the future of cryptocurrencies. Democrats won control of both chambers of Congress, jeopardizing President Donald Trump’s plans for more favorable regulation of digital assets. Although bitcoin weakened immediately after the election, it subsequently climbed back above the $80,000 mark. What does the result mean for the crypto market, and should investors be worried?

The American crypto industry has experienced an unusual week. The political environment in which it had invested hundreds of millions of dollars changed fundamentally in a single election. While just a few months ago companies operating in the digital asset space were hoping for the swift adoption of new laws, they will now have to negotiate with a Congress in which Democrats hold the upper hand.

The result of Tuesday’s election triggered a surprising reaction in the markets. Bitcoin first headed toward multi-week lows, but then surged sharply. On the morning of Thursday, November 5, its price was hovering around $80,500. Investors are thus beginning to distinguish between short-term price movements and long-term political risks.

Democrats Will Take Control of Congress. Trump Loses Key Support

In the US congressional elections on November 3, the Democratic Party scored a decisive victory. According to the Associated Press, it won control of both the House of Representatives and the Senate. Republicans thus lost the majorities that had so far helped President Donald Trump push through his political priorities.

The new Congress will take office on January 3, 2027. For the remaining two years of Trump’s presidential term, this means a considerably more complicated political situation. The change will not affect only traditional areas such as taxes, government spending or foreign policy. It may also have significant consequences for the crypto industry, which has become an important political player in recent years.

During his second term, Trump has pushed for a more welcoming approach to digital assets. His administration supported the creation of a strategic bitcoin reserve, eased some regulatory crackdowns and sought simpler conditions for crypto companies to do business.

The continuation of this policy is now uncertain. Democrats have long called for greater investor protection, stricter oversight of certain crypto services and more rigorous scrutiny of potential conflicts of interest. That does not mean, however, that all Democratic lawmakers are against cryptocurrencies. Part of the party supports their development and merely advocates different rules for how the market should operate.

Bitcoin Initially Weakened. Then Came a Surprising Turnaround

Crypto markets reacted to the first election results with a decline. During Wednesday’s trading, bitcoin briefly dropped to roughly $75,700, one of its lowest valuations in recent weeks. Buyers then quickly returned.

According to CoinDesk, bitcoin was trading around $80,484 on Thursday morning, having gained approximately 5.7 percent over the previous 24 hours. Other cryptocurrencies also rose significantly. Ether added around eight percent and solana almost six percent.

Why did the market rise when the election produced a potentially less favorable regulatory environment? One explanation is the removal of political uncertainty. Investors now know what balance of power to expect over the next two years and can adjust their strategies accordingly.

Another factor was developments in the broader financial markets. US stocks gained, the dollar weakened and oil prices fell sharply. Investors began betting that a Democratic majority in Congress would increase pressure to end the conflict with Iran, which could help ease inflationary pressures.

Bitcoin thus once again behaved much like other risk assets. In the short term, its price was driven primarily by investors’ willingness to take on risk, not merely by expected crypto regulation. Even so, the current recovery does not automatically mean the end of the weaker period. The largest cryptocurrency remains well below its all-time highs from 2025.

Key Crypto Legislation Is at Risk

One of the most important consequences of the US elections may be the fate of the bill known as the CLARITY Act. It was meant to create clearer rules for cryptocurrency trading in the United States. Its main goal was to determine which digital tokens fall under the oversight of the Securities and Exchange Commission (SEC) and which under the Commodity Futures Trading Commission (CFTC).

For crypto companies, this is a crucial issue. The existing ambiguity complicates decisions about which products they can offer, what licenses they need and what obligations they must meet. The CLARITY Act was meant to reduce this uncertainty while also introducing rules for the registration of certain intermediaries and for customer protection.

The bill, however, ran into trouble even before the election. In September 2026, it failed a key procedural vote in the Senate. It needed 60 votes to advance but received only 50. Democrats and four Republican senators voted against it.

The Democrats’ election victory now further reduces the chances of the bill being passed in its current form. According to a CoinDesk analysis, representatives of the crypto industry expect they will have to return to negotiations over key parts of the bill. Some analysts even consider the current version of the legislation politically unviable.

The new Democratic majority could primarily demand stronger consumer protection, stricter anti-money-laundering rules and greater scrutiny of potential conflicts of interest.

For investors, it is important to note that stricter regulation does not necessarily mean a negative outcome. Clearly defined obligations can boost confidence in crypto companies and make it easier for traditional financial institutions to enter the market. The problem is rather prolonged uncertainty if politicians fail to agree on new rules.

The crypto industry spent hundreds of millions of dollars. Its biggest bet didn’t pay off

The election results are also unwelcome news for cryptocurrency companies that sought to shape the future makeup of the U.S. Congress through political financing. According to the Reuters news agency, organizations linked to the crypto industry spent roughly $200 million during the current election cycle. Over the past two election cycles, their spending has reached around half a billion dollars.

The money went toward supporting candidates from both major political parties who were willing to push for more favorable legislation for digital assets. The most notable defeat came in Ohio.

According to Reuters, organizations linked to the crypto industry spent more than $60 million trying to prevent Democrat Sherrod Brown from returning to the Senate. Brown is known for his critical stance toward some practices of cryptocurrency companies. Despite the massive campaign, however, he won the election.

The outcome shows that even exceptionally high political spending does not guarantee the crypto sector the influence it expects. The picture, however, is not clear-cut. A significant share of the candidates backed by Fairshake won their races. The crypto industry has therefore not lost all of its political allies; it will simply have to operate in an environment that will be less receptive to its existing priorities.

Does the election result mean the end of Trump’s crypto policy?

No. Although the Democrats will gain control of Congress, President Donald Trump remains in office and his administration retains some of its regulatory powers.

U.S. supervisory institutions can continue preparing rules, and the president can use his executive powers. However, the new Democratic majority will gain the ability to oversee the administration’s activities, hold investigative hearings, and block certain legislative proposals or personnel nominations. At the same time, laws that have already been passed do not disappear simply because of an election.

One example is the GENIUS Act, which Trump signed in July 2025. The law creates a federal regulatory framework for payment stablecoins, that is, digital tokens whose value is pegged to, for example, the U.S. dollar.

Stablecoins are precisely one of the most important tools of the crypto economy. They make it possible to move funds between platforms and trade without constantly having to convert money into traditional currencies.

A change of majority in Congress does not mean that this law will cease to apply. It may, however, affect its further implementation as well as the adoption of follow-up rules.
