Most recently, the German platform Bitcoin.de ran into its requirements, with its operator failing to obtain the necessary license. Trading, meanwhile, has been largely suspended for several months. The company is now looking for a way to resume its services and assures clients that their cryptocurrencies remain safe. The case demonstrates how significant an impact the new European regulation can have even on established players in the cryptocurrency market.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">German financial regulator BaFin refused to grant a license under the European MiCA regulation to futurum bank AG, which operates the well-known cryptocurrency platform Bitcoin.de. The decision was announced on October 6 by its parent company Bitcoin Group SE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The platform operator applied for the license as early as June 27, 2025. Even after more than fifteen months, however, it failed to convince the regulator that it met all required conditions. According to <a href=\"https:\/\/www.bitcoingroup.com\/en\/adhocmitteilung\/2026\/bitcoin-group-se-bafin-refuses-micar-authorisation-applied-for-by-futurum-bank-ag\" target=\"_blank\" rel=\"noopener\">Bitcoin Group SE&#8217;s official announcement<\/a>, the regulator&#8217;s previous tolerance, which allowed the company to provide cryptocurrency services without the new authorization, simultaneously ended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an unpleasant complication for the platform, which is among Germany&#8217;s long-standing providers of cryptocurrency trading services. Regulator Unsatisfied with Company&#8217;s Preparedness<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although BaFin&#8217;s decision was announced only this week, Bitcoin.de&#8217;s problems are not entirely new. The company had, in fact, suspended most trading activities as early as June 12 this year. According to its statement, it had been preparing for a possible license rejection in advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fundamental question remains why the German regulator rejected the application. A detailed justification for the administrative decision has not yet been published, but the parent company has provided at least an explanation of its perspective on the entire process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Moritz Eckert, CEO of Bitcoin Group SE, BaFin concluded that neither the current level of implementation of the required measures nor the progress the company could achieve in the near future is sufficient for granting a <a href=\"https:\/\/crypto-globe.com\/firemni-nakup-kryptomen-otc-poplatky-mica\/\" target=\"_blank\" rel=\"noopener\">license<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company&#8217;s management disagrees with the conclusion. However, it admits that the rejection of the application represents a significant obstacle to the platform&#8217;s continued operation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As stated in <a href=\"https:\/\/www.bitcoingroup.com\/en\/corporatenews\/2026\/bitcoin-group-se-futurum-bank-ag-prepares-alternative-operating-model-for-bitcoin-de\" target=\"_blank\" rel=\"noopener\">Bitcoin Group SE&#8217;s press release<\/a>, the company is now reviewing the decision and considering filing an objection. The decision can be appealed within one month of its delivery. The loss of regulatory authorization does not automatically mean that the company has lost customer assets or has become insolvent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bitcoin Group SE states in its <a href=\"https:\/\/www.bitcoingroup.com\/en\/adhocmitteilung\/2026\/bitcoin-group-se-bafin-refuses-micar-authorisation-applied-for-by-futurum-bank-ag\" target=\"_blank\" rel=\"noopener\">official statement<\/a> that futurum bank AG will continue to safeguard client assets until they are transferred to another regulated provider. According to the company, all customer claims remain preserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a significant difference compared to cases where cryptocurrency exchanges collapsed due to a lack of <a href=\"https:\/\/crypto-globe.com\/en\/over-50000-europeans-pressure-the-eu-over-stablecoins-they-want-to-ease-mica-rules\/\" target=\"_blank\" rel=\"noopener\">liquidity<\/a> or misappropriation of client funds. In Bitcoin.de&#8217;s case, the publicly announced problem is primarily the unsuccessful licensing procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the company&#8217;s assurances alone do not constitute an independent confirmation of the status of all client assets. Customers should therefore monitor the platform&#8217;s official information, especially regarding the conditions for further custody and any transfer of <a href=\"https:\/\/crypto-globe.com\/en\/massive-crackdown-on-hackers-police-dismantle-socksescort-network-and-freeze-millions-in-cryptocurrency\/\" target=\"_blank\" rel=\"noopener\">cryptocurrencies<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The operator is simultaneously working on an alternative business model. The company&#8217;s management speaks of a timeframe of several weeks, but has not yet confirmed a specific date. For cryptocurrency service providers, the relevant rules became applicable from December 30, 2024, with some companies able to utilize a transitional period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, this, according to <a href=\"https:\/\/www.esma.europa.eu\/publications-and-data\/interactive-single-rulebook\/mica\/article-143-transitional-measures\" target=\"_blank\" rel=\"noopener\">Article 143 of the European MiCA regulation<\/a>, will end by July 1, 2026, at the latest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From this date, companies can no longer rely solely on previous national authorizations or transitional regimes. To continue providing services, they must have the appropriate authorization under the new regulatory framework, or operate under another regime expressly permitted by MiCA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Acquiring a license is not merely an administrative formality. Providers must meet requirements concerning, for example, risk management, internal control mechanisms, client asset protection, organizational structure, and service provision methods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regulators also assess whether the declared procedures are genuinely implemented and functional. Its requirements can also fundamentally impact established companies that have been operating in the market for many years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For some providers, MiCA necessitates extensive investments in technology, internal processes, and regulatory compliance. Others may conclude that obtaining a license independently is too costly or organizationally demanding, and will begin collaborating with already licensed institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bitcoin.de now intends to take the latter path. According to <a href=\"https:\/\/www.bitcoingroup.com\/en\/adhocmitteilung\/2026\/bitcoin-group-se-bafin-refuses-micar-authorisation-applied-for-by-futurum-bank-ag\" target=\"_blank\" rel=\"noopener\">the operator&#8217;s announced plan<\/a>, trading and custody of cryptocurrencies should be handled through cooperation with regulated German partners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From the perspective of the entire industry, the new conditions are expected to contribute to further consolidation of the European cryptocurrency market. Smaller providers may seek strategic partners, merge with larger players, or gradually discontinue some services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the one hand, this could mean higher costs and a reduction in offerings. Individual platforms can operate through multiple companies, and a well-known name alone does not indicate who provides the specific service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The scope of the granted authorization also deserves attention.
