The German Ministry of Finance is now preparing a fundamental change. It wants to bring cryptocurrency taxation closer to that of stocks and tax profits from newly purchased assets regardless of how long they are held. If the proposal passes, the new rules would apply to cryptocurrencies purchased from 2027 onwards.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Germany is preparing to revise one of the rules that has made it a relatively favorable country for long-term cryptocurrency investors. The Federal Ministry of Finance, led by Lars Klingbeil, has prepared a proposal according to which profits from bitcoin, ethereum, and other selected crypto assets would in future be taxed similarly to other capital income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the proposal, which the German newspaper <a href=\"https:\/\/www.handelsblatt.com\/politik\/deutschland\/steuern-finanzministerium-plant-wohl-besteuerung-von-kryptowerten-ab-2027-01\/100253020.html\" target=\"_blank\" rel=\"noopener\" title=\"\">Handelsblatt<\/a> has seen, the current long-term holding advantage would primarily be abolished. For cryptocurrencies acquired from 2027 onwards, it would no longer be possible to wait one year and then realize any profit without tax.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposal also envisages moving relevant profits into the capital income regime with a basic rate of 25%. However, this is not yet an approved law. Cryptocurrencies held in private assets are considered so-called other economic assets under German tax law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an investor buys and sells a cryptocurrency within one year, any profit may fall under income from private sales and be subject to taxation. However, once more than one year has elapsed between purchase and sale, according to current rules, the sale is generally outside this regime and the profit may be exempt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The German Federal Ministry of Finance <a href=\"https:\/\/www.bundesfinanzministerium.de\/Content\/DE\/Downloads\/BMF_Schreiben\/Steuerarten\/Einkommensteuer\/2025-03-06-einzelfragen-kryptowerte.html\" target=\"_blank\" rel=\"noopener\" title=\"\">states<\/a> that profits from cryptocurrencies held in private assets may be considered income from private sales if no more than one year has elapsed between acquisition and sale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of a sale during this period, the current system also includes a threshold of 1,000 euros for total annual profit from private sale transactions. If the total profit is lower, it remains exempt provided legal conditions are met. The rule comes directly from <a href=\"https:\/\/www.gesetze-im-internet.de\/estg\/__23.html\" target=\"_blank\" rel=\"noopener\" title=\"\">\u00a7 23 of the German Income Tax Act<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is precisely this time test that makes cryptocurrencies something different from, say, ordinary stock investments from a tax perspective. An investor who bought bitcoin and simply held it for more than a year could subsequently realize even a very significant profit without paying tax on it in Germany. And it is precisely this difference that the German government wants to eliminate.<\/p>\n\n\n\n<h2 id=\"aioseo-co-chce-nemecko-od-roku-2027-zmenit-12\" class=\"wp-block-heading\">What does Germany want to change from 2027?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">According to the current proposal, selected crypto assets should be moved under the rules for capital income. Profits would thus be taxed regardless of whether the investor owned the cryptocurrency for several months, five years, or, for example, ten years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The basic German capital income tax is 25%. A solidarity surcharge of 5.5% of the tax itself is added to this. The effective taxation without any possible church tax thus works out to approximately 26.375%.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to information from <a href=\"https:\/\/www.coindesk.com\/business\/2026\/09\/09\/germany-moves-to-tax-bitcoin-like-stocks-as-new-draft-bill-targets-tax-free-gains\" target=\"_blank\" rel=\"noopener\" title=\"\">CoinDesk<\/a>, the regime should apply primarily to exchangeable crypto assets such as <a href=\"https:\/\/crypto-globe.com\/en\/is-rektember-coming-bitcoin-has-entered-its-historically-problematic-month-but-this-year-could-be-different\/\" target=\"_blank\" rel=\"noopener\" title=\"\">bitcoin<\/a> and ether. Some other types of tokens, such as <a href=\"https:\/\/crypto-globe.com\/en\/mica-is-just-the-beginning-the-eu-now-wants-to-crack-down-on-defi-staking-and-nfts\/\" target=\"_blank\" rel=\"noopener\" title=\"\">NFTs<\/a>, selected stablecoins, security tokens, or tokenized real assets may remain outside the proposed regime or may be subject to other rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For long-term investors, this would be a significant change. Today, their tax liability may be zero after exceeding the annual time test. In the new system, simply waiting would not eliminate the tax liability. Paradoxically, however, the reform might not be disadvantageous for everyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An investor who today buys and sells cryptocurrencies within one year may tax the profit according to their personal tax burden. For people with high incomes, the rate may thus be higher than the proposed 25% capital gains tax. According to information released so far, <a href=\"https:\/\/crypto-globe.com\/en\/european-crypto-has-a-new-leader-germany-now-records-79-mica-licenses\/\" target=\"_blank\" rel=\"noopener\" title=\"\">Germany<\/a> does not plan to apply the new system retroactively to already-owned cryptocurrencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Assets purchased by the end of 2026 should retain the current tax regime. The new rules should only apply to cryptocurrencies acquired after December 31, 2026. In practice, one investor could therefore own two portions of the same cryptocurrency subject to different rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if a German bought bitcoin in December 2026, this part of the investment would, according to the current proposal, remain in the old regime and, after fulfilling the annual time test, could be sold without tax. Additional bitcoin purchased in January 2027 would no longer be able to use the time test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For investors, therefore, the importance of precise records of individual purchases, their acquisition prices, and acquisition dates would increase even further.<\/p>\n\n\n\n<h2 id=\"aioseo-dan-by-mely-postupne-vybirat-samotne-platformy-24\" class=\"wp-block-heading\">The tax should gradually be collected by the platforms themselves<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The reform is not only meant to change the amount of tax itself, but also the way it is collected. According to the known version of the proposal, cryptocurrency service providers should start automatically withholding tax for some clients from 2028, similar to traditional financial products. The year 2027 should serve platforms as a transition period to adjust their systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This demonstrates the broader trend in which cryptocurrency regulation in Europe is heading. Bitcoin emerged outside the traditional banking infrastructure, but its purchase, holding, and taxation are increasingly approaching mechanisms known from the classic financial market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For <a href=\"https:\/\/crypto-globe.com\/en\/top-10-worst-investments-in-crypto-history-projects-that-wiped-out-billions-for-investors-2\/\" target=\"_blank\" rel=\"noopener\" title=\"\">investors<\/a>, this could mean simpler administration on the one hand. In subsequent years, revenue is expected to gradually increase to approximately 350 million euros annually.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ministry justifies the change by stating that cryptocurrencies have gradually become a more common form of private capital investment. According to the ministry, the current system creates a distinction between cryptocurrencies and other investment assets that is increasingly difficult to defend.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From the government&#8217;s perspective, therefore, this is not only about finding additional budget revenue. The reform is meant to definitively bring bitcoin and other cryptocurrencies closer to the world of traditional investments also from a tax law perspective.<\/p>\n\n\n\n<h2 id=\"aioseo-co-by-zmena-znamenala-pro-dlouhodobou-strategii-hodl-34\" class=\"wp-block-heading\">What would the change mean for the long-term HODL strategy?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the fundamental strategies among cryptocurrency investors is the so-called HODL, meaning long-term holding of an asset regardless of short-term price movements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current German tax environment indirectly favors this strategy. The annual time test creates a clear incentive not to sell the cryptocurrency too soon. In addition to potential further price appreciation, the investor also gains a significant tax advantage after one year has elapsed. If the time test disappeared, this effect would be lost.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investor could make selling decisions more based on actual market developments, their investment strategy, or capital needs, because from a tax perspective there would be no fundamental difference between selling after eleven months and, for example, after five years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Germany&#8217;s attractiveness for wealthier cryptocurrency holders may also change. Tax conditions represent only part of the regulatory environment, and Germany remains one of the largest and most developed European economies with an extensive financial market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, for private long-term investors, this would be a significant change. The ability to realize virtually unlimited profit from bitcoin after just one year without tax is among the exceptionally favorable rules. Its removal could therefore change not only investors&#8217; tax obligations but also their investment decision-making.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, it reminds us that with the growing size of the cryptocurrency market, its formerly exceptional status is gradually disappearing. European regulation is increasingly trying to integrate digital assets into the existing financial system, whether it concerns rules for service providers, client identification, transaction reporting, or indeed taxes.<\/p>\n\n\n\n<h2 id=\"aioseo-reforma-zatim-neni-definitivni-44\" class=\"wp-block-heading\">The reform is not yet definitive<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For investors, it is important that current German rules are not changing at this moment. The Ministry of Finance&#8217;s proposal still must go through the legislative process, and modifications may be made to the final law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, if the reform passes in its current form, the year 2027 will create a clear boundary in the German cryptocurrency market. Cryptocurrencies purchased before its implementation should retain the current regime. For new <a href=\"https:\/\/crypto-globe.com\/en\/south-korea-tightens-rules-for-crypto-influencers-they-must-disclose-their-investments\/\" target=\"_blank\" rel=\"noopener\" title=\"\">investments<\/a>, on the other hand, one of the greatest benefits that long-term holding of bitcoin in Germany has offered so far would cease to exist.
